Wrongful death lawsuit filed in IV case

An Odessa man, his mother-in-law and his late wife’s former partner have filed a wrongful death lawsuit against Revitalize Health & Wellness and a registered nurse.

According to the lawsuit filed Thursday in Ector County District Court, Revitalize provides clinic or mobile intravenous therapy, weight loss consultations and hormone optimization therapy.

On April 2, 2023, Revitalize employee, Mayra Colorado, a registered nurse, came to the home of Raul Palma III, Ashly Flores, their two children, and the child she shared with Alfredo Acosta.

The lawsuit alleges Colorado gave the 30-year-old Flores a rapid infusion of at least 951 cubic centimeters in less than 30-minutes resulting in Flores suffering a seizure and full cardiac arrest.

Flores was taken to Medical Center Hospital and she died a few hours later. According to the lawsuit, her death certificate lists fluid overload and rapid infusion of intravenous solution as the cause of death.

Palma, Acosta and Flores’ mother, Ginia Rivera Flores, allege Revitalize “violated the duty of care it owed to Ashly Flores” and Colorado “violated the standard of care she owed” Flores.

The lawsuit states Colorado didn’t ask Flores about any pre-existing medical conditions or medicine she was taking, didn’t properly assess or observe Flores during the infusion, didn’t take the appropriate steps to determine the rate of the infusion and didn’t render “timely and appropriate medical treatment” to Flores to stop the infusion.

Palma and Flores are seeking unspecified punitive and compensatory damages on their own behalf and on behalf of Flores’ two youngest children. Acosta is seeking the same on behalf of the child he shared with Flores.
