Odessan arrested on robbery charge

A 35-year-old Odessa man was arrested on suspicion of robbery/family violence Thursday night after police responded to a shots fired call at the West Texas Oil Change on East 8th Street.

According to an Odessa Police Department report, a 38-year-old woman said she and her boyfriend, Justin Najera, 35, got into an argument about her phone when Najera was dropping her off at the business.

The woman said Najera refused to give her her iPhone 15 so she refused to get out of his vehicle. According to the report, the woman said Najera punched her in the shoulder and pushed her head into the front passenger window to get her out of the vehicle.

When she got out, the woman told officers she reached inside to get her phone from Najera and he grabbed her arm multiple times, the report stated.

According to the report, the woman said she grabbed Najera’s gun to make sure he didn’t get it. She said she accidentally pulled the trigger and the gun went off, with the bullet hitting the pavement.

Najera, she said, drove off.

According to the report, Najera denied that a gun was ever fired, but acknowledged arguing with his girlfriend. He said the argument was over his refusal to give her a straight answer about their relationship.

Najera also told officers he had his girlfriend’s phone, but said it was because she left it in the truck, the report stated.

Officers arrested Najera after observing fresh red marks and other injuries on the woman, the report stated. He was released from the Ector County jail Friday after posting a $25,000 surety bond.
