A 31-year-old man was arrested Sunday after he reportedly choked and slammed his sister to the ground.
Eric Aguirre was charged with assault to family member with impeding breathing and circulation (family violence), a third-degree felony.
The assault reportedly happened at 4:03 p.m. Sunday in the 1600 block of Hemphill Avenue, an Odessa Police Department affidavit stated.
Officers were dispatched to the residence and before OPD got out of their patrol units, a woman identified as Aguirre’s sister, approached the officers with several children, the affidavit detailed. She was reportedly bleeding from her mouth, near her right ear, right side of face and her right eye was swollen and bruised, the affidavit detailed.
The woman told officers she had gotten into an altercation with her brother, the affidavit stated. She reportedly stated her brother grabbed her by the neck, slammed her down and caused her to stop breathing. The woman had a hoarse voice when speaking to officers.
Officers knocked on the front door of the residence and heard a bang from the back of the house. Aguirre had fled out the back window and was headed west, the affidavit stated. Officers found Aguirre hiding behind dumpsters near Stripes, located at 3210 W. 16th St.
Aguirre’s initial statement was that his sister had gotten into his face and scratched him, the affidavit detailed. He stated he pulled his sister’s hair and “pinned her to the ground.” Aguirre reportedly didn’t specify anything further.
Aguirre had scratch marks from his upper neck area down to his torso, which is reportedly consistent with a person defending themselves from an assault, the affidavit stated. He also had a cut on the side of his right hand, but didn’t state how he got it.
Officers spoke with several children at the scene, all of them stated they saw Aguirre and his sister pushing each other, fighting each other and both being hurt, the affidavit detailed.
This was the second time in about two months that Aguirre was arrested after he reportedly assaulted a family member, jail records show. He was also charged Feb. 4 with assault family violence restricting airway, a third-degree felony.
Aguirre was arrested, charged and transported to the Ector County Law Enforcement Center. He has one bond totaling $7,500 and was still in custody as of Tuesday afternoon, jail records show.
