Man arrested on burglary charge

An Odessa man was arrested last week after a woman told police she woke up partially naked with him touching her.

According to an Odessa Police Department report, the woman called police around 9 p.m. June 17 from a motel in the 2000 block of West Second Street.

When officers arrived, she told him she began taking a nap around 4 p.m. and woke up at 8:45 p.m. to find her underwear missing and John Luis Fermin-Diaz touching her legs, the report stated. She ordered him to leave, called police and realized $20 was missing from her room.

Fermin-Diaz told officers the woman’s door was wide open and he tried to wake her up after seeing she was naked from the waist down, the report stated. He said he returned the woman’s dog to the room and shut the door.

However, an officer wrote in the report that video surveillance showed the woman’s door was only slightly ajar when Fermin-Diaz entered her room and he stayed four minutes before leaving.

A witness told officers she saw the woman sleeping in her underwear and Fermin-Diaz entering the room, the report stated.

Fermin-Diaz was arrested on suspicion of burglary of a habitation with intentions of committing another felony. He remained in the Ector County jail Monday night on a $25,000 surety bond.
