An Odessa man who struck a deal with prosecutors in an aggravated assault with a deadly weapon case was arrested Monday after his probation officer accused him of violating the deal.
According to online Ector County District Court records, Kolby Ray Tavarez, 20, admitted back in January to using a pair of scissors to cut someone and he was placed on community supervision for a period of five years.
Under the terms of the plea agreement, Tavarez’s guilty plea will not be entered into the system unless he fails to successfully complete his community supervision, but court records show that on May 20, prosecutors filed a motion asking he be arrested and adjudicated guilty.
According to the motion, Tavarez was arrested May 15 on suspicion of possession of a controlled substance of more than 28 grams, but less than 200 grams. His community supervision officer further accused him of possessing or using Xanax, possessing, using, selling or having a narcotic drug, moving without telling his officer and failing to submit to random drug testing.
Tavarez was booked into the Ector County jail and is being held without bond.
