Odessan found not guilty in assault

A 50-year-old Odessa man accused of sexually assaulting an intoxicated woman three years ago was found not guilty by an Ector County jury.

According to a judgment document filed Tuesday in Ector County District Court, a jury acquitted Dominguez Celectino Hernandez in June in connection with an alleged assault that took place Dec. 19, 2021.

Court records also indicate the Ector County District Attorney’s Office dismissed the case against Hernandez’s co-defendant, Kimberly Ayala, 35, in June, stating the case couldn’t be proven beyond a reasonable doubt.

According to an Odessa Police Department report, a 19-year-old woman told officers she got into an argument with her boyfriend at The Escape Lounge and Hernandez and Ayala not only intervened, but offered her a ride and a place to stay because she couldn’t get money out of an ATM.

The woman said she must have blacked out in their vehicle because she woke up at a trailer in the 200 block of South Tom Green Avenue being sexually assaulted by Hernandez, the report stated.

The report stated the 19-year-old said she was able to get away by saying she was going to throw up on Hernandez. She said she gathered up clothes on the floor and fled.

She was taken to Medical Center Hospital for a sexual assault nurse examiner exam and the nurse found markings on her neck and scratches consistent with her claim of being choked, the report stated.

Hernandez told officers the woman vomited on herself during the ride to his home and once they arrived she showered and they had consensual sex, the report stated.

According to the report, Ayala told police Hernandez had consensual sex with both her and the 19-year-old woman.
